5. Mine Community Development
            A mining right holder is required to achieve a balance between mining   BEE
            operations and a mining community’s social economic needs. Mining right
            holders are required to:
            •  Develop a social and labour plan in consultation with municipalities,
               communities and affected stakeholders.
            •  The plan must be published and approved.
            •  100% of the plan must be implement within any given financial year.

            6. Housing and Living Conditions
            Mining right holders are required to improve the standard of housing and living
            conditions of the employees as stipulated in the Housing and Living Conditions
            Standard for the Mining and Minerals Industry. The mining right holders shall be
            required to submit a Housing and Living Conditions Plan for approval by the
            Department. Clear targets and timelines shall be agreed on for implementation
            of the Housing and Living Conditions Plan.

            It is clear that MCIII contains many new concepts and mining companies and
            prospective mining companies would be well advised to address their BEE
            planning  early. You  are  correct  that  the  MCIII  definitely  has  a  stronger  focus
            on companies becoming at least 51% black owned but it is not an absolute
            requirement at this stage.




            YES to higher BEE levels

            “I’ve taken note of the new Youth Employment Service initiative issued by
            Government and am very excited about the opportunities it offers to improve
            the BEE level of my business. I am however struggling to understand what I
            need to do to contribute and benefit from this. Can you help explain more?”
            On  28  August  2018  the Youth  Employment  Service  Initiative  (“YES  Initiative”)
            within  Code Series 000, Statement 000  of the Amended  BEE Codes of Good
            Practice was published in the Government Gazette and became effective
            immediately.

            The YES Initiative is an initiative between Government, organised labour, civil
            society and young persons with the aim of creating jobs for youth.  There
            is  currently  an  estimated  six  million  young  persons  in  our  country  who  are
            unemployed and the  YES Initiative aims to address this unemployment by
            creating at least one million new jobs.
